Kansas Health Care Freedom Act Fails
The Kansas Health Care Freedom Act did not pass the house vote today in Topeka. The bill would have accomplished the following goals:
1. A law or rule could not compel directly or indirectly, any person, employer or health care provider to participate in any health care system or purchase health care insurance.
2. A person or employer may pay directly for lawful health care services and shall not be required to pay penalties or fines for paying directly for lawful health care services.
3. A health care provider may accept direct payment for lawful health care services and shall not be required to pay penalties or fines for accepting direct payment from a person or employer for lawful health care services.
4. Subject to reasonable and necessary rules the purchase or sale of health insurance in private health care systems shall not be prohibited by law or rule.
5. The resolution does not affect:
a. Which health care services are permitted by law.
b. Prohibit care relating to workers compensation.
c. Prohibit care related to state employee benefit plans.
d. Laws or rules in effect as of August 1st 2009.
